MANAGEMENT OF TERRITORIAL COMMUNITY DEVELOPMENT UNDER MARTIAL LAW AND POST-WAR RECONSTRUCTION

Abstract

The article analyzes the financial and economic capacity of the united territorial community, reveals the essence and significance of the processes of formation and development of the united territorial community, identifies the problems of local self-government before the start of the decentralization reform. The theoretical foundations of the formation of united territorial communities, the essence, tasks and principles of the decentralization reform, as well as the regulatory and legal regulation of the creation and functioning of united territorial communities in Ukraine are analyzed, on the basis of which it is proven that the above is a complex multi-level system that includes constitutional norms, basic and sectoral laws, by-laws, and international standards. It has been determined that the essence of local government reform is to create an effective system of territorial organization of power, based on the principles of subsidiarity, ubiquity, financial self-sufficiency, and democracy. It is found out that the legislative system is constantly being improved in accordance with the challenges of modernity, in particular, it is adapted to the conditions of martial law, which ensures the possibility of effective functioning of local government even in emergency circumstances. It is substantiated that the budget plan is a condition for the effective functioning of the community, since financial indicators reflect both the state of the economic base of the territory and the effectiveness of management decisions of local government bodies. The article states that a capable community is defined as one that has sufficient financial, human and infrastructure resources to independently ensure the proper level of public service provision. The reform objectives include overcoming excessive fragmentation of local councils, ensuring financial autonomy of communities through securing stable sources of income, expanding powers in the areas of education, healthcare, social protection and land use, as well as strengthening democratic principles through the introduction of participatory democracy tools. The article systematizes the problems of local self-government before the start of the decentralization reform by spheres of influence, and identifies possible consequences for community activities. It is noted that the catastrophic impact of the full-scale war affected the financial architecture of the community, the restoration of which is possible after de-occupation and the activation of large-scale international reconstruction programs.
